General Terms and Conditions (GTC)

1. Scope
These terms and conditions apply to all orders placed by consumers (§ 13 BGB) via the online shop of
NuKa 2001 UG (limited liability), Allee der Kosmonauten 32, 12681 Berlin, represented by the managing director Ani Shahnazaryan (hereinafter referred to as "Seller").

2. Contracting parties
The purchase agreement is concluded with NuKa 2001 UG (limited liability).

3. Special features of the goods offered
(1) The items offered are predominantly used, unique pieces. Signs of use or wear do not constitute a defect.
(2) Some items are sold on behalf of customers (consignment goods). These are marked accordingly.

4. Conclusion of the contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer.
(2) By clicking the “Buy now” button, you submit a binding offer. The contract is concluded as soon as we confirm the order by email.

5. Prices and shipping costs
(1) All prices are final prices. Due to the small business regulation (§ 19 UStG), no VAT is shown.
(2) Shipping costs will be added and will be shown during the order process.
(3) Deliveries abroad are possible upon request. Shipping costs will be calculated individually.

6th delivery
(1) Delivery is made via DHL within Germany.
(2) Shipping will take place within 2 working days after receipt of payment.

7. Payment
The following payment options are available:

  • credit card

  • PayPal

  • Instant bank transfer

  • Klarna

  • Other payment methods offered at checkout (via Shopify Payments/Stripe).

8. Right of withdrawal
(1) Consumers generally have a right of withdrawal of 14 days.
(2) This right does not apply to goods sold on behalf of a customer (Section 312g paragraph 2 no. 10 of the German Civil Code).
(3) The buyer shall bear the costs of return shipping.

9. Warranty
(1) The statutory warranty rights apply.
(2) For used goods, the warranty period is one year from delivery.
(3) The reduction shall not apply to damages resulting from injury to life, body or health, nor to damages resulting from intentional or grossly negligent breaches of duty.
(4) In the case of consignment goods, the sale is made in the name and on behalf of the respective consignor. Any warranty claims must be made against the consignor.

10. Retention of title
The goods remain our property until full payment is received.

11. Jurisdiction and applicable law
German law applies. The place of jurisdiction is Berlin, provided the buyer is a merchant or has no residence in Germany.
